2. Nature of Services

Financial Lynx is a consulting and marketplace platform that connects businesses with third-party lenders, banks, and financial institutions.

• Financial Lynx is not a lender, bank, or financial institution

• We do not guarantee approvals, rates, or funding

• All financing decisions are made solely by third parties

3. No Financial, Legal, or Tax Advice

All information provided by Financial Lynx is for general informational purposes only and should not be considered financial, legal, or tax advice.

4. User Representations & Responsibilities

You agree that:

• All information submitted is accurate and complete

• You are authorized to provide such information

• You will not submit false, misleading, or fraudulent information

• You will not misuse or attempt to disrupt our platform

5. Consent to Communications (TCPA Compliant)

By submitting your information through our website forms or other opt-in methods, you expressly consent to receive communications from Financial Lynx, including calls, emails, and SMS messages, including those sent using automated systems where permitted by law.

SMS Terms:

• Message frequency varies based on user interaction and account activity

• Message and data rates may apply

• Reply STOP to opt out at any time

• Reply HELP for assistance

• Consent is not a condition of purchase

• You may withdraw consent at any time

No mobile information will be shared, sold, or conveyed to third parties for marketing or promotional purposes.

6. Third-Party Relationships

Financial Lynx may share your information with third-party lenders and partners to provide financing options.

We are not responsible for:

• Credit decisions

• Loan terms, rates, or agreements

• Any loss or damages resulting from third-party transactions

7. Fees & Compensation

Financial Lynx may earn fees for services rendered, including consulting and/or success-based fees, which will be disclosed in a separate written agreement.

Non-Circumvention

You agree not to directly or indirectly engage, transact with, or obtain financing from any lender, partner, or institution introduced by Financial Lynx without honoring Financial Lynx’s fee agreement.

This provision shall survive termination of services for a period of 24 months from the date of introduction.

8. Limitation of Liability

To the fullest extent permitted by law, Financial Lynx shall not be liable for any indirect, incidental, or consequential damages arising from:

• Use of our services

• Reliance on information provided

• Third-party financing arrangements

9. Indemnification

You agree to indemnify and hold harmless Financial Lynx, its affiliates, and representatives from any claims, damages, or liabilities arising from:

• Your use of the services

• Your violation of these Terms

• Any inaccurate or misleading information provided

10. Privacy

Your use of our services is also governed by our Privacy Policy, available on our website.

11. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided shall be resolved exclusively through binding arbitration.

• Arbitration shall take place in New York

• Conducted under the rules of the American Arbitration Association (AAA)

• You waive the right to participate in class actions or jury trials

12. Governing Law

These Terms shall be governed by the laws of the State of New York.

13. Entire Agreement

These Terms constitute the entire agreement between you and Financial Lynx and supersede all prior agreements or understandings.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

15. Modifications to Terms

We reserve the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of any changes.
